1. Acceptance of Terms
By installing, accessing, or using any NodeZap product ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you ("User", "you", or "your") and NodeZap ("we", "us", or "our").
2. Description of Service
NodeZap builds applications distributed via various marketplaces including Atlassian Marketplace, Google Workspace Marketplace, and Shopify App Store. Our apps automate workflows and enhance productivity within these platforms.
3. License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use our Apps in connection with your platform instances.
4. User Responsibilities
You agree to:
- Comply with Platform Terms: Your use of our Apps is subject to the respective platform's terms of service
- Secure Your Credentials: Keep tokens and credentials confidential
- Authorized Use: Only use the Apps for their intended purpose
- Accurate Configuration: Ensure settings are correctly configured
You agree NOT to:
- Reverse engineer, decompile, or disassemble the App
- Use the App to transmit malicious content or spam
- Circumvent any security features or access controls
- Use the App in violation of any applicable laws
5. Intellectual Property
All rights, title, and interest in NodeZap products, including all intellectual property rights, remain with NodeZap. These Terms do not grant you any rights to our trademarks, logos, or branding.
6. Data and Privacy
Your use of our Apps is subject to our Privacy Policy, which describes how we collect, use, and protect your data.
7. Service Availability
7.1 Availability
Our Apps depend on third-party platform infrastructure. We do not guarantee 100% uptime. Availability is subject to platform availability and scheduled maintenance.
7.2 Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Apps at any time, with or without notice.
8. Disclaimer of Warranties
THE APPS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, non-infringement, and accuracy or reliability of results.
9. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, business, or goodwill
- Any damages arising from your use or inability to use the Apps
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD, WHICHEVER IS GREATER.
10. Indemnification
You agree to indemnify, defend, and hold harmless NodeZap from any claims, damages, losses, or expenses arising from your use of the Apps, your violation of these Terms, or your violation of any third-party rights.
11. Termination
11.1 By You
You may terminate your use of any App at any time by uninstalling it from your platform instance.
11.2 By Us
We may terminate or suspend your access immediately, without prior notice, if you breach these Terms or we are required to do so by law.
11.3 Effect of Termination
Upon termination, your license ends immediately and stored configuration data will be deleted per platform policies.
12. General Provisions
12.1 Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full force and effect.
12.2 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the Apps.
12.3 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be posted with an updated "Last Updated" date. Continued use of our Apps after changes constitutes acceptance.
